These Terms of Service ("Terms") govern your access to and use of Destiny AI Astrology, including our mobile applications, website, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
IMPORTANT NOTICE: These Terms contain a binding arbitration agreement and class action waiver in Section 20. Please read it carefully. It affects how disputes between you and Destiny AI Astrology are resolved.
By creating an account, subscribing, making a purchase, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference. These Terms apply to all users, including free users, paid subscribers, and one-time purchasers.
The Services are intended for users 13 years of age and older. By using the Services, you represent that you meet this age requirement. We recommend that users under 18 years of age use the Services with the awareness of a parent or guardian.
Destiny Matching™ is available only where both profiles being matched belong to individuals who are 18 years of age or older. By submitting two profiles for a Destiny Matching™ session, you represent that both individuals whose information you are submitting are 18 years of age or older.
This restriction applies to the profiles being matched, not to the age of the account holder initiating the match. A user of any eligible age may use this feature, provided that both profiles submitted for matching meet the 18 years of age requirement.
Account holders may create profiles for family members, including minors, for the purpose of generating horoscope readings and birth chart analysis. The account holder is solely responsible for any information submitted for such profiles and confirms they have the appropriate authority to provide that information.
We may update these Terms from time to time as the Services evolve. For non-material changes, updated Terms will be posted within the app or on our website with a revised "Last Updated" date, and your continued use of the Services constitutes acceptance.
For material changes (including changes to dispute resolution, fees, or how we handle your data), we will provide notice through the Services or by email at least thirty (30) days before the changes take effect. If you do not agree to the updated Terms, you must stop using the Services before the changes take effect.
Destiny provides astrology features that use artificial intelligence to generate personalized, informational, and reflective astrological insights. These features may include, but are not limited to:
Some features may be available for free, while others require a paid subscription (on mobile applications) or a one-time purchase (on our website). Features, availability, and functionality may vary by platform, region, or purchase type and may change over time.

Destiny AI Astrology is not responsible for life decisions made based on the Services.
Destiny Matching™ generates astrological compatibility insights based on Vedic astrology frameworks and AI-assisted interpretation. These outputs are informational in nature and do not constitute advice on whether to pursue, continue, or end any relationship or marriage.
Any indication within the Services that a compatibility match is unfavorable, not recommended, or otherwise cautioned against is based solely on astrological interpretation and does not reflect a definitive assessment of any relationship's potential, suitability, or outcome. Such outputs should not be construed as a directive or recommendation to make or refrain from any personal decision, including decisions related to marriage.
Destiny AI Astrology expressly disclaims any responsibility for relationship outcomes, marital decisions, or any consequences arising from a user's reliance on compatibility outputs generated by the Services.
The Services rely on artificial intelligence models provided by third-party providers.
While we strive to accurately interpret the astrological frameworks we use, we do not guarantee the correctness, consistency, or completeness of any output. You use the Services at your own discretion and risk.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Depending on your subscription tier or purchase, you may create and manage multiple profiles within your account, including profiles of yourself, friends, or family members. For each profile, you may also add one or more partner profiles for use with Destiny Matching™, subject to the eligibility requirements set out in Section 2.2.
By submitting information about other individuals, you represent that you have the lawful authority and necessary permission to do so and accept full responsibility for that information.
On our mobile applications (iOS and Android), we offer subscription plans. Subscription plans, features, and pricing are subject to change at any time. Pricing may vary by region and platform. Prices are generally displayed in INR for users located in India and in USD for users in other regions, subject to applicable taxes and platform rules.
On our website, we offer one-time purchases only. We do not offer recurring subscriptions on our website. There are no automatic renewals, recurring charges, or auto-billing associated with website purchases.
Current Offering: 100 Questions for One Month. A website one-time purchase entitles you to ask up to one hundred (100) questions through the Services within a thirty (30) day period beginning on the date of purchase. Any questions not used within the thirty (30) day period will expire and are non-refundable. Unused questions do not roll over to any future purchase.
For purposes of this offering, a "question" means each individual prompt submitted by you that generates an AI response, regardless of length or topic. Follow-up messages within a conversation count as separate questions. Failed responses caused by Service errors will not count against your question allowance.
Right to Modify or Discontinue. We may modify, suspend, or discontinue the website one-time purchase offering at any time, including in connection with the public launch of our mobile applications. If we discontinue the offering:
We may introduce new purchase types, subscription plans, or other offerings on the website or other platforms at any time. Any such offerings will be governed by these Terms and any additional terms presented at the time of purchase.
Some plans or purchases may describe usage as "unlimited." This means there is no fixed numerical limit under normal personal use. We reserve the right to apply fair-use limits, rate limits, or other safeguards to prevent abuse, protect system stability, and manage operational costs. Excessive, automated, abusive, or exploitative usage may result in restrictions, suspension, or termination.
Prices displayed may be exclusive of applicable taxes, duties, or similar government charges, which may be added at checkout or as required by applicable law.
Payments, renewals, cancellations, and refunds for mobile app subscriptions are handled by Apple or Google, respectively, and are subject to their policies. We do not control or override platform refund decisions.
Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date through your Apple ID or Google Play account settings.
Website purchases are processed through third-party payment providers. Because website purchases are one-time and non-recurring, no auto-renewal occurs and no further charges will be made unless you initiate a new purchase.
Refund Policy: You may request a refund for a website one-time purchase within seven (7) days of the purchase date, provided that you have used fewer than five (5) questions from your purchased allowance. Purchases on which five (5) or more questions have been used, or for which the seven (7) day window has elapsed, are not eligible for refund.
Refunds for purchases that have expired (i.e., the thirty (30) day access period has ended) will not be granted, regardless of the number of unused questions remaining.
To request a refund, contact us at support@destinyastrology.com with your order details. Refund eligibility outside the above conditions may be granted at our sole discretion or as required by applicable law. Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
Deleting your account does not automatically cancel any active mobile subscription. Before deleting your account, you are responsible for canceling any active subscription separately.
For iOS subscriptions, cancellations must be managed through your Apple ID settings. For Android subscriptions, cancellations must be managed through the Google Play Store. Links to manage your subscriptions are available within the app for your convenience.
Destiny AI Astrology is not responsible for any subscription charges that continue to accrue following account deletion where the subscription has not been separately canceled. Refunds for such charges, if applicable, are subject to the policies of Apple or Google and are outside our control.
One-time website purchases are not affected by account deletion in terms of further charges, as no recurring billing exists. However, deleting your account may permanently remove your access to any features or content unlocked through a one-time purchase, and no refund will be provided for such loss of access.

All content, software, designs, features, functionality, text, graphics, logos, and materials provided through the Services are owned by Destiny AI Astrology and are protected by applicable intellectual property and proprietary rights laws.
Except as expressly permitted under these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Services without prior written permission from Destiny AI Astrology.
If you believe content available through the Services infringes your copyright, you may submit a notice to our designated agent at:

Your notice should include: (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing and its location; (iv) your contact information; (v) a statement that you have a good faith belief that use of the material is not authorized; and (vi) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We may remove or disable access to material claimed to be infringing and may terminate accounts of repeat infringers.
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your information. Please review it carefully.
We may suspend or terminate your account or access to the Services, with or without notice, if:

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Destiny AI Astrology disclaims all warranties, express or implied, including warranties of merchantability, accuracy, reliability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, in no event shall Destiny AI Astrology, its founders, employees, or agents be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services, including but not limited to loss of profits, data, goodwill, or relationship outcomes, whether based on contract, tort, strict liability, or any other legal theory, even if advised of the possibility of such damages.
In no event shall Destiny AI Astrology's total aggregate liability arising out of or relating to these Terms or the Services exceed the greater of (i) the amount you paid to Destiny AI Astrology in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless Destiny AI Astrology and its founders, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from:
This indemnification obligation does not apply to claims arising from Destiny AI Astrology's gross negligence or willful misconduct.
If you access the Services through an application downloaded from the Apple App Store, the following additional terms apply, and they prevail over any conflicting provision in these Terms:
If you access the Services through an application downloaded from Google Play, you acknowledge that these Terms are between you and Destiny AI Astrology only, and not with Google LLC. ("Google"). Google is not responsible for the Services or their content. Your use of the application must comply with the then-current Google Play Terms of Service.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Before filing any formal claim, you agree to first contact us at support@destinyastrology.com and provide a brief written description of the dispute and your contact information. The parties will attempt in good faith to resolve the dispute informally within sixty (60) days.
If the dispute is not resolved informally, you and Destiny AI Astrology agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through final and binding individual arbitration, except for the carve-outs in Section 20.5.
Administrator. For users located in the United States, the arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. For users located outside the United States, the arbitration shall be administered by the International Centre for Dispute Resolution ("ICDR"), the international division of AAA, under its International Dispute Resolution Procedures. The applicable rules are available at www.adr.org.
Language. The arbitration shall be conducted in English.
Seat and Location. For users located in the United States, the seat of arbitration shall be the United States county where you reside, or such other location as the parties mutually agree in writing. For users located outside the United States, the seat of arbitration shall be Bangalore, Karnataka, India.
Hearings. Arbitration hearings may, at the arbitrator's discretion and upon request of either party, be conducted by telephone, video conference, or in person. For claims under USD $25,000 (or its local-currency equivalent), hearings will be conducted by telephone or video conference unless the arbitrator determines an in-person hearing is necessary.
Fees. Arbitration fees and costs shall be allocated in accordance with the applicable AAA or ICDR rules, including any consumer fee schedule or minimum standards that limit the fees payable by individual consumers.
You and Destiny AI Astrology agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
You may opt out of this arbitration agreement by sending written notice to support@destinyastrology.com within thirty (30) days of the latest to occur of: (i) your first acceptance of these Terms, (ii) the effective date of these Terms if you previously accepted a prior version of the Terms that did not contain an arbitration agreement, or (iii) the effective date of any future material amendment to this Section 20.
Your notice must include your name, account email, and a clear statement that you wish to opt out. Opting out will not affect any other provision of these Terms.
This Section 20 does not apply to: (i) claims for injunctive or equitable relief relating to intellectual property; (ii) small claims court actions, where eligible; and (iii) claims that, by applicable law, cannot be subject to arbitration.
These Terms shall be governed by and construed in accordance with the laws of Karnataka, India, without regard to conflict of law principles, except as required by applicable mandatory consumer protection laws of your jurisdiction.
Note: This governing law clause should be revisited once Destiny AI Astrology is incorporated in the United States. A Delaware (or other US-state) governing law clause is strongly recommended for a US-based company with US users.
These Terms, together with the Privacy Policy and any additional terms presented at the time of purchase or subscription, constitute the entire agreement between you and Destiny AI Astrology regarding the Services and supersede any prior agreements.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
The failure of Destiny AI Astrology to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Destiny AI Astrology may freely assign these Terms, including in connection with a merger, acquisition, financing, or sale of assets.
Destiny AI Astrology shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, government action, internet or telecommunications failures, or failures of third-party providers including AI model providers.
Section headings are for convenience only and do not affect interpretation.
Sections that by their nature should survive termination (including Sections 6, 7, 12, 15, 16, 17, 20, 21, and 22) shall survive termination of these Terms.
